Help Us Pass Freelance Isn’t Free in California!

This past February, California State Senator Scott Wiener introduced Senate Bill 988 (SB 988) or as we like to call it, the Freelance isn’t Free Act. As in other parts of the country, where we have been successful in implementing similar laws, it aims to ensure fundamental protections for freelance workers, enforced by the State Labor Commissioner and the Attorney General. These protections include the right to a contract, prompt payment within 30 days of completing work, and the right to double damages for non-payment.

We took a huge step in February of 2023 when we passed similar legislation in the City of Los Angeles, but it only applies to work performed within county limits. By expanding this legislation statewide, we can ensure that you will have basic labor protections, like prompt payment and the right to a contract. We believe that from San Diego to Sacramento all Californians deserve to be covered under the law.

What can you do to help pass this legislation? There’s a few ways!

  1. Voice your support with our template: Head to https://freelancersunion.org/email-legislator/ and fill out the form to send a message to your legislators to voice your support for Freelance Isn’t Free, which includes protections like the right to a contract, prompt payment within 30 days of completing work, and the right to double damages for non-payment.
  2. Contact your representative directly: Visit https://findyourrep.legislature.ca.gov/ to find your find their assembly member and senator, click “contact me” on their page, then choose “Comment on Bill or Legislation” from the dropdown menu. There you can write out and submit your letter of support!
